PRIVACY POLICY – LÜDIQ

Communications

Personal information collected by LÜDIQ may be collected, processed, and analyzed by our partners, as applicable. This may include communications outside Quebec as well as communications without consent permitted by law. In many cases, communication is incidental to collection, meaning that the information must be communicated to the partner prior to its use by LÜDIQ.

Important information

Personal information collected on the website is used and disclosed for identification purposes. The collection and use of personal information for identification purposes is disabled by default on the website. You can enable these features by authorizing the collection of personal information for identification purposes by approving the choice in the window that appears when you access our Site.

Your rights

The law gives you the right to access, correct, and withdraw consent to your personal information. For more details on how to exercise your rights, please refer to sections 8 to 11 of this Policy.

Implied consent

Any person who communicates with LÜDIQ consents to the collection, use, and disclosure (as described in section 3.3) of their personal information for the purposes mentioned in sections 2.2, 2.3, 2.4, 2.6, and 3.

1. PURPOSE OF THE POLICY

Legal framework. In accordance with the Act respecting the protection of personal information in the private sector (CQLR c P-39.1) as amended by the Act to modernize legislative provisions as regards the protection of personal information, LÜDIQ (hereinafter “LÜDIQ,” “we,” or “our”) implements measures to protect your personal information.

Objectives of the Policy. This privacy policy (hereinafter the “Policy”) governs LÜDIQ’s privacy practices with respect to the personal information you voluntarily share with us when you visit the LÜDIQ website, communicate with us through social media, or contact us using the means of your choice (telephone, email, etc.). The main purpose of this Policy is to inform you about:

  • The personal information we collect from you and for what purposes
  • How we use your personal information
  • To whom we may disclose your personal information
  • What choices you have regarding the collection and use of personal information
  • What types of security procedures are in place to protect your personal information
  • What your rights are with respect to this personal information (right of access, rectification, and withdrawal of consent)
  • The retention and destruction of your personal information
  • How to contact us if you have questions, comments, or complaints

2. WHAT PERSONAL INFORMATION DO WE COLLECT AND FOR WHAT PURPOSES?

2.1. Personal information collected from website visitors

Automatic collection. Through a pop-up window, visitors to the website can accept or refuse the automatic collection of the following personal information when using our website:

Information related to website browsing: for analytical purposes, i.e., to demonstrate the volume, origin, and technical characteristics of traffic on our website, we collect the following information from visitors to the site (when available):

  • Their IP address
  • Their browser
  • Their device
  • Their operating system
  • Their Internet service provider
  • The date and time of their visits
  • The pages they visit

Information related to the segmentation of the person visiting the site: for marketing purposes, i.e., measuring the effectiveness of our campaigns and other marketing projects, as well as segmenting target audiences, we collect the following information from visitors (when available):

  • Their spoken language
  • Their country of origin
  • Their gender (if applicable)
  • Their age group
  • The forms they submit through the website

Information related to website personalization: for personalization purposes, i.e., adapting the website to the visitor’s preferences, we collect information about the preferences established by visitors.

Collection through cookies. This personal information is collected through the use of cookies. A cookie is a small data file stored on the visitor’s device by a Site server.

2.2. Personal information collected from newsletter subscribers

In order to receive LÜDIQ newsletters, subscribers agree to provide their name and email address. Newsletter subscribers may also be asked to share their preferences regarding the receipt of specialized newsletters.

2.3. Personal information collected from housing applicants

Mandatory information. When applying to live in LÜDIQ housing, applicants will be asked to provide various personal details during the application process, including:

  • Their personal identity
  • Their family situation
  • Their financial situation
  • Their professional situation
  • Their personal and professional references
  • His/her current residential status

Applications will only be processed once this information has been provided.

Sociodemographic information collected for research purposes. In order to better fulfill its mission of developing affordable housing tailored to the needs of families, LÜDIQ collects additional sociodemographic information about housing applicants. This information is provided voluntarily by the housing applicant and is not considered when processing the application.

Customer relationship technologies. In order to manage its relationships with applicants and business partners, LÜDIQ uses customer relationship technologies (commonly known as CRM). Any information provided during a communication or business meeting with LÜDIQ may be recorded using these technologies. This includes, in particular, name, postal addresses, email addresses, telephone numbers, organization, position or title, and meeting history.

2.4. Personal information collected from Tenants

The following personal information is collected on a mandatory basis as part of any rental relationship with LÜDIQ:

Continuity of personal information of applicants. Any personal information mentioned in the previous section, i.e., that collected in connection with housing applications, may be reused in the context of relationships with Tenants.

Information about the rental agreement. By signing a lease and any annexes related to the lease, the tenant provides personal information about the housing and amenities rented from LÜDIQ, as well as the tenant’s living conditions.

Payment information. LÜDIQ keeps a record of payments and late payments for each of its Tenants.

Communications, references, confirmations, and community life. LÜDIQ keeps personal info in the form of private communications between LÜDIQ and its Tenants, letters of reference and housing confirmations for third parties, and any other conversations related to the Tenant’s community life.

2.5. Personal information collected from business contacts and partners

Customer relationship technologies. In order to manage its relationships with its various business partners, LÜDIQ uses customer relationship technologies. Any information provided during a business communication or meeting with LÜDIQ may be recorded using these technological means. This includes, in particular, name, postal addresses, email addresses, telephone numbers, organization, position or title, and meeting history.

3. FOR WHAT PURPOSES DO WE COLLECT THIS PERSONAL INFORMATION AND TO WHOM DO WE DISCLOSE YOUR PERSONAL INFORMATION?

3.1. What are the purposes of personal information?

Purposes of personal information. We also collect information for the following purposes:

  • To evaluate the functionality, effectiveness, and usability of our website
  • To evaluate the reach and traffic of specific pages on our website
  • To evaluate the effectiveness and efficiency of our marketing operations
  • To evaluate the reach of our newsletters and analyze subscriber interest
  • Analyze and segment housing applicants
  • Analyze and segment tenants
  • Respond to specific requests from tenants and applicants
  • Communicate personalized information or offers to tenants
  • Produce reports and statistics related to the occupancy of our properties
  • Promote the services offered by LÜDIQ
  • Ensure the proper management of our rental properties
  • Ensuring the proper management of relationships with our customers and partners
  • Develop new affordable housing projects
  • Contribute to research on affordable housing

3.2. Collection and use of personal information for identification purposes

Authorization to collect personal information for identification purposes. Due to the use of the aforementioned cookies, we use visitors’ personal information for identification purposes. The collection and use of personal information for identification purposes is disabled by default. You can enable these features by authorizing the collection of personal information for identification purposes by approving the choice in the window that appears when you access our Site. You can also authorize this feature in our privacy settings.

3.3. Who do we share personal information with?

Information collection, processing, and analysis partners. LÜDIQ may use partners to collect, process, and analyze personal information, particularly in the context of housing development projects. These partners are bound to LÜDIQ by personal information protection and confidentiality agreements.

Incidental disclosure during collection. The collection of information may involve incidental disclosure to a partner, meaning that the information must be disclosed to the partner prior to its use by LÜDIQ. This applies in particular to cases where the partner provides hosting services, collection forms, transmission, or computer processing of information to LÜDIQ.

Disclosure outside Quebec. Consequently, your personal information may be disclosed outside Quebec.
Communications without consent permitted by law. We may also disclose your personal information without consent in circumstances where this is permitted or required by applicable law.

4. CONSENT

Any person who uses the Site or communicates with LÜDIQ voluntarily consents to the collection, use, and disclosure of their personal information for the above-mentioned purposes and to the above-mentioned entities (see sections 2 and 3).

5. HOW LONG DO WE KEEP PERSONAL INFORMATION?

Destruction of personal information once the purposes have been fulfilled, except where the law imposes a retention period. In accordance with our procedures for the secure retention and destruction of personal information, we only retain personal information for as long as necessary for the purposes for which it was collected and to comply with our legal obligations. After that, personal information will be destroyed in a secure manner.

6. HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

Protective measures. We use physical, technological, and administrative safeguards to protect your personal information and reduce the risk of unauthorized and/or illegal access, use, disclosure, and destruction. Without limiting the generality of the foregoing, we:

  • Minimization: We consciously limit the personal information we collect. We only collect personal information that is necessary to fulfill the identified purposes.
  • Confidentiality commitments: require each member of our team and our representatives who have access to your personal information to sign a confidentiality agreement
  • Training: ensure that every member of our team and our representatives who have access to your personal information receive training in privacy and personal information protection
  • Access restrictions: We restrict access to your personal information to employees who need it to fulfill one of the purposes listed above.
    Privacy incident log: We maintain a privacy incident log in accordance with applicable legislation.

7. VISITOR CHOICES

Changing our privacy settings. All visitors to the site can choose the privacy settings that best suit their needs. By default, these settings are set to provide you with the best possible protection.

Changes to cookie settings on your web browser. You can manage the processing of your personal information by cookies by changing your browser settings. However, your refusal to accept cookies may impair or limit your access to certain features of our Site.

8. HOW TO WITHDRAW YOUR CONSENT TO DISCLOSURE OR USE?

Your right to withdraw your consent to disclosure or use. Subject to applicable law and your contractual obligations, you may withdraw or modify your consent to the use or disclosure of your personal information. To do so, please contact our Privacy Officer (see the procedure in section 11). However, if you withdraw your consent to certain uses or disclosures of your personal information, we may no longer be able to provide you with certain services or the quality of our services may be affected.

9. HOW CAN YOU ACCESS YOUR PERSONAL INFORMATION?

Content of the right of access. You have the right to access your personal information. As such, you may ask us to:

  • Inform you of the existence of personal information about you
  • Receive a communication of your personal information
  • Consult your personal information on site during business hours or remotely, and obtain a copy
  • Ask us to disclose any information collected from you in a structured and commonly used technological format

Reasonable fees may apply. Reasonable fees may be charged for the transcription, reproduction, or transmission of your personal information.

10. HOW TO CORRECT YOUR PERSONAL INFORMATION?

Content of the right to rectification. You may submit a request to bonjour@ludiq.org to rectify your personal information in the following circumstances:

  • Your personal information is inaccurate
  • Your personal information is incomplete
  • Your personal information is ambiguous
  • The collection, disclosure, or retention of your personal information was not authorized by law

11. PROCEDURE FOR REQUESTING ACCESS, CORRECTION, AND WITHDRAWAL OF CONSENT

Procedure. To be considered, all requests under sections 8 to 10 must be made in writing to LÜDIQ’s privacy officer by emailing bonjour@ludiq.org.

Obligation to prove your identity. You will be required to prove your identity before we can accept your request.

Response times. We are legally required to respond (favorably or unfavorably) to any request for access or rectification within 30 days of receiving it and confirming your identity.

12. COMPLAINTS PROCEDURE

Complaint procedure. You may file a complaint about our governance or privacy practices with LÜDIQ’s Privacy Officer by emailing bonjour@ludiq.org.

13. UPDATES TO THIS POLICY

Possible changes. We may change this Policy from time to time, in accordance with applicable law. We will notify you of any changes to this Policy by indicating the date of the last changes at the beginning of this Policy.

Implied consent to changes. Your continued use of the Site or your provision of personal information to us following the posting of changes to this Policy constitutes your implied consent to the changes to this Policy, subject to the provisions of applicable law.

14. CAUTION REGARDING THIRD-PARTY WEBSITES

Disclaimer. LÜDIQ is not responsible for any information that may be collected, used, or disclosed by any third-party website you visit, and LÜDIQ expressly disclaims any liability related to such collection, use, disclosure, or retention by such third parties.
